Gemboard.ai Terms of Use

1. Agreement
By creating an account, signing in, accessing an API, or using Gemboard.ai, you agree to these Terms and the Privacy Policy. If you use Gemboard.ai for an organisation, you represent that you are authorised to bind it.
2. Your inputs and responsibilities
You retain any rights you lawfully hold in content you submit. You represent that you have all permissions needed to upload and process it. You must not submit confidential, personal, infringing, unlawful, deceptive, or restricted material unless you have authority and an appropriate lawful basis.
3. Research and improvement licence
To operate and improve Gemboard.ai, you grant Gemboard.ai and its service providers a worldwide, non-exclusive, royalty-free, sublicensable licence to host, reproduce, transform, analyse, annotate, create technical derivatives from, and otherwise use your inputs, generated images, edits, feedback, and related metadata for providing the service, security, quality evaluation, model and product research, testing, and improvement. This licence continues for copies already incorporated into de-identified or aggregated research datasets, evaluation records, backups, or model improvements, to the extent permitted by law. It does not transfer ownership of your pre-existing content to Gemboard.ai.
4. Generated outputs
To the extent permitted by applicable law and subject to third-party rights, you may use outputs generated for your account. Gemboard.ai does not promise that an output is unique, original, copyrightable, non-infringing, commercially suitable, or unavailable to other users. Similar or identical outputs may be generated for others.
5. No design, manufacturing, or accuracy warranty
Generated images, weights, dimensions, stone details, specifications, CAD or 3DM files, costing information, and recommendations are probabilistic drafts for concept development. They may be inaccurate, incomplete, inconsistent, impossible to manufacture, unsafe, or unsuitable for a particular purpose. You must independently review and validate every output with qualified designers, engineers, CAD professionals, manufacturers, legal advisers, and other appropriate specialists before production, sale, publication, or reliance.
6. API use
API availability, response format, models, limits, pricing, and features may change. You are responsible for credentials, integrations, rate limits, downstream use, security, validation, and compliance. You may not bypass limits, probe for vulnerabilities, disrupt the service, extract models or training data, or use the API unlawfully.
7. Availability and changes
Gemboard.ai may be modified, interrupted, suspended, rate-limited, or discontinued. Maintenance, provider failures, network conditions, security events, or experimental features may affect availability. No uptime, preservation, compatibility, or uninterrupted-access commitment applies unless stated in a separately signed service agreement.
8. Disclaimer
Gemboard.ai is provided “as is” and “as available.” To the maximum extent permitted by law, Gemboard.ai disclaims implied warranties including accuracy, merchantability, fitness for a particular purpose, title, non-infringement, and results. Nothing in these Terms excludes a warranty or remedy that applicable law does not permit the parties to exclude.
9. Limitation of liability
To the maximum extent permitted by law, Gemboard.ai and its affiliates, personnel, and providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss; lost profits, revenue, data, designs, goodwill, or business opportunity; manufacturing loss; or claims arising from reliance on outputs, API use, third-party services, or service interruption. Any aggregate liability will be limited to fees you paid Gemboard.ai for the affected service during the three months before the event giving rise to the claim. This limitation does not apply where liability cannot lawfully be limited.
10. Indemnity
To the extent permitted by law, business users will defend and indemnify Gemboard.ai against third-party claims arising from their inputs, products, unlawful use, infringement, manufacturing decisions, or breach of these Terms, except to the extent caused by Gemboard.ai’s conduct for which liability cannot lawfully be excluded.
